Terms & Condition

1. Acceptance of Terms
By engaging Meade Landscaping (“we,” “us,” or “our”) for services, you (“client” or “customer”) agree to be bound by these Terms and Conditions. Please read them carefully before proceeding with any work.

2. Estimates and Proposals
All estimates and proposals provided by Meade Landscaping are valid for 30 days from the date of issuance. Prices are based on the scope of work described in the proposal. Any changes to the scope of work may result in adjusted pricing, which will be communicated to the client before implementation.

3. Project Commencement and Deposits
A signed proposal and deposit may be required to secure your project start date. The deposit amount will be specified in your proposal. Work will not begin until the signed agreement and deposit are received.

4. Change Orders
If the client requests changes to the original scope of work after the project has begun, a change order will be created outlining the revised scope and any associated cost adjustments. Both parties must approve the change order in writing before the additional work proceeds.

5. Payment Terms
Payment terms will be outlined in your proposal. Unless otherwise agreed upon in writing:

⦁ A deposit may be required to schedule the project
⦁ Progress payments may be due at specified project milestones
⦁ Final payment is due upon completion of the work
⦁ We accept cash, check, and credit card payments

A finance charge of 1.5% per month (18% APR) may be applied to balances outstanding beyond 30 days from the invoice date. The client is responsible for all collection costs, including reasonable attorney’s fees, should an account be turned over for collection.

6. Client Responsibilities
The client agrees to:

⦁ Provide clear access to the work area
⦁ Ensure that all underground utilities are marked before excavation begins (through 811 or similar services)
⦁ Obtain any necessary HOA approvals or neighborhood covenants
⦁ Secure any required permits, unless otherwise agreed in writing
⦁ Keep children and pets away from active work areas for their safety

7. Timeline and Delays
Project start and completion dates provided in estimates are best-faith estimates based on current schedules and weather predictions. Meade Landscaping is not responsible for delays caused by:

⦁ Weather conditions (rain, snow, extreme temperatures, etc.)
⦁ Material shortages or supplier delays
⦁ Unforeseen site conditions (rock, utility conflicts, etc.)
⦁ Client requested changes or delays
⦁ Acts of God or other circumstances beyond our control

We will communicate any anticipated delays as soon as possible.

8. Warranty
Plant Materials: We warrant that all plants, trees, and shrubs are healthy at the time of installation and will be replaced if they fail to thrive within 30 days of planting, provided they have been properly cared for by the client. This warranty does not cover damage from neglect, improper watering, vandalism, severe weather, or pest infestations.

Hardscape and Irrigation: All hardscape and irrigation installations are warranted against defects in workmanship for one year from the date of completion. This warranty covers repairs needed due to faulty installation but does not cover damage caused by:

⦁ Settling of ground or natural site conditions
⦁ Tree root intrusion
⦁ Freeze/thaw cycles
⦁ Vehicle traffic or other heavy impacts
⦁ Normal wear and tear
⦁ Client modifications or repairs by others

Snow Removal: Snow removal services are provided on an as-needed basis. We strive to respond promptly to weather events but cannot guarantee specific arrival times due to road conditions and storm intensity.

9. Safety and Site Conditions
Meade Landscaping carries general liability insurance and takes reasonable precautions to protect your property during work. However, underground lines, sprinkler systems, or unseen site conditions may occasionally be impacted despite best efforts. We will make every effort to notify you immediately and address any issues that arise.

The client is responsible for marking all private underground lines (such as invisible dog fences, private sprinkler lines, or unmarked utilities) prior to excavation.

10. Clean-Up
We perform daily clean-up of the work area and a final clean-up upon project completion unless otherwise specified in your proposal. This includes removal of debris and excess materials from the site.

11. Photographs and Marketing
Meade Landscaping may take photographs of completed work for portfolio, website, and marketing purposes unless the client requests otherwise in writing prior to project commencement.

12. Cancellation and Rescheduling
If you need to cancel or reschedule a project, please provide as much notice as possible. Cancellation of a confirmed project less than 72 hours before the scheduled start date may result in a cancellation fee not exceeding 10% of the estimated project total to cover materials ordered and time reserved.

13. Limitation of Liability
To the fullest extent permitted by law, Meade Landscaping’s total liability for any claims, damages, or losses arising from or related to the work performed shall not exceed the total amount paid by the client for the specific project giving rise to the claim. Meade Landscaping shall not be liable for any indirect, incidental, or consequential damages.

14. Entire Agreement
These Terms and Conditions, together with the signed proposal or estimate, constitute the entire agreement between Meade Landscaping and the client. Any modifications must be in writing and signed by both parties.

15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado. Any legal action arising out of or relating to these terms shall be filed in the courts of Larimer County, Colorado.

16. Acceptance
By signing a proposal or estimate, or by allowing work to commence, the client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
